Vietnamese trademark system operates in a similar way to other countries, protecting characters, words, drawings, or images, including three-dimentional images, or any combination of these items, represented in one or more colors.
Vietnamese trademark law also recognizes the rights of unregistered trademarks if the unregistered trademarks are widely known by Vietnamese consumers (Well-known trademarks).
Under Vietnam’s IP Law, a trademark will be eligible for registration if it meets the following criteria:
- A mark is not identical or confusingly similar to marks that have been registered by others
- A mark is sufficiently distinctive for the general public or consumers to believe that goods or services bearing the trademark are different from the products of others
- A mark must not be forbidden under the Vietnam’s IP Law.
A trademark registration will be valid for a period of 10 years from the filing date. It can be renewed for another 10 years, with no limitation on how many times. A renewal request of the registration must be filed within 6 months before its registration expires.
Vietnam is a member of the Paris Convention and if you want to file a trademark application for registration in Vietnam, priority claims can be made within 6 months of application in another convention country.
The registration process for trademark may take 15-17 months from the date of filing.
